Is Your AI Leaking Client Data?

Issue #12 | The settings real estate agents should change in ChatGPT and Gemini to protect your client's personal secrets.

As a real estate professional, you're juggling data privacy every day. Every time you log into a service with your Google account or handle client info in your CRM, you're part of a complex data ecosystem.

AI tools like ChatGPT and Gemini are no different—they are just the newest, most powerful tools to deal with data issues. By default, they learn from your conversations. This isn't just to "train AI"—it's how they develop "memory" and give you those amazing, personalized answers that understand your context and workflow.

But the default settings are not optimized for real estate agents. This isn't a reason to panic, but it is a reason to be smart. This is your guide to finding the right balance—how to adjust settings to protect your clients while still taking advantage of AI's power.

NOTE: I’m focusing on ChatGPT and Gemini in this issue but competitors (e.g., Claude business tiers) state they don’t use customer data for training by default; Grok and others vary so you should treat them like Gemini unless your contract says otherwise.

The Core Difference: Consumer vs. Enterprise AI

Are you using the free ChatGPT? Geimini Pro? At the end of the day leveraging your brokerage protection of the system data is one of the best ways to avoid privacy issues.

  • Consumer Tools (ChatGPT Plus, Gemini Advanced): On Gemini, you are forced to bundle "Chat History" and "Model Training" together. On ChatGPT, you can separate them, but it requires management of your settings.

  • Enterprise Tools (ChatGPT Team, Gemini Enterprise): These paid, business-level tools solve the conflict. Both platforms decouple "History" from "Training" by default. Your data is never used for training or human review.

3 Paths to AI Privacy Control

🔒 Path 1: Maximum Security

This path trades all convenience for absolute, verifiable privacy. You get total amnesia—no chats are saved, nothing is used for training, and your conversations are deleted from the systems (after 30 days for OpenAI, 72 hours for Google).

THE HOW-TO (ChatGPT)

  • Use "Temporary Chat" Mode: For every new sensitive conversation, click the model name (e.g., "GPT-4o") at the top-left of the chat window and toggle ON "Temporary Chat".

  • Result: Chats in this mode are not saved to your history, not used for training, and deleted after 30 days. This achieves maximum security for that chat only.

  • (Optional but Recommended) Double Check Training: Go to "Settings" > "Data Controls" > Ensure "Improve the model for everyone" is OFF. This stops training even for non-temporary chats.

THE HOW-TO (Gemini): Go to "gemini.google.com" > "Activity" (clock icon) > "Gemini Apps Activity" > Select Turn off.

⚖️ Path 2: The Balance

This path is the best-in-class setup for a solo agent using a consumer tool. It's a two-panel setup to keep your chat history but stop both OpenAI and the AI itself from "passively learning" from it.

  • Step 1: Block OpenAI Training (The "Data Controls" Panel)

    • Go to "Settings" > "Data Controls".

    • Toggle "Improve the model for everyone" OFF.

    • Result: Your chat history is saved, but OpenAI promises not to use it for training.

  • Step 2:Control AI Memory (The "Personalization" Panel)

    • Go to "Settings" > "Personalization".

    • Toggle "Reference chat history" OFF.

    • Result: This is the key. You've stopped the AI from "passively learning" from your chats and using client data across sessions.

    • Leave "Reference saved memories" ON.

    • Result: This enables your "Smart Memory." The AI will only remember facts you explicitly tell it to or approve.

🛡️ Path 3: The Brokerage Solution

Thankfully most agents are at a brokerage so you should be with one that empowers the Enterprise editions as it’s the only secure way to use memory on Gemini. Upgrading your to ChatGPT Team or Gemini Enterprise (for Workspace) solves the problem.

  • THE HOW-TO: This is set by your administrator.

  • WHAT HAPPENS (Both Platforms):

    • No Training: Your prompts and outputs are never used to train the public models.

    • No Human Review: Your data is not reviewed by human annotators.

    • Secure, Separate History: The system does keep a chat history, but it's for your team's reference and (for Gemini) admin-controlled auditing.

Solo Agent - Smart Memory

If you're a solo agent on ChatGPT Plus, you can block the training data and focus on your "Smart Memory."

1. Build Your Curated "Smart Memory" With "Reference saved memories" ON, you now have a safe, manual memory. Go to "Settings" > "Personalization" > "Memory" > "Manage" to see what the AI has saved.

  • Example - What to Add:

    • "I am a real estate agent in New York City."

    • "My professional tone is approachable, confident, and empathetic."

    • "Always format market reports with bullet points and a one-paragraph summary."

  • Example - What to Delete if it Appears:

    • "My client [Client Name] is selling 123 Main St."

    • Any other confidential deal information.

    • Pro-Tip: Check this "Manage" screen a few times a month. The AI may try to "helpfully" add memories.

The Bottom Line (Why You Should Care)

Understanding these settings isn't about "locking down" your AI—it's about using it with intent. The "magic" of AI memory and the "duty" of client privacy are in direct conflict only on the consumer tools. Recent UI changes make achieving perfect privacy on consumer ChatGPT more cumbersome (requiring per-chat action) but there is likely to be more updates in the future that continue to add new levels of control

You now have a clear, informed choice:

  • For Max Security: Use Path 1. For ChatGPT, this means diligently using "Temporary Chat" mode for every sensitive interaction. For Gemini, it's the global "Activity Off" switch.

  • For a Smart Balance (Solo Agent on ChatGPT): Go with Path 2. This two-panel setup gives you persistent history and a curated, manual memory without letting OpenAI train on your data or the AI passively learn sensitive details. This is the recommended setup for individuals willing to manage settings.

  • For Any Serious Team/Brokerage: Go with Path 3. Upgrading to "ChatGPT Team" or "Gemini Enterprise" is the only way to get persistent AI memory and guaranteed privacy easily on both platforms. This remains the most professional, hassle-free solution.

The default consumer settings are a liability. By making an informed choice, you get the best of the tool that works for the highly private work of a real estate agent.
